Terms and Conditions

Page title: Terms and Conditions · Shopify slug: terms-of-service

1. Scope

(1) These Terms and Conditions ("Terms") set out the basis for every order placed through the online shop at xevora.com between the operator of xevora.com (hereinafter "XEVORA", "we", "us") and the shopper (hereinafter "you", "Shopper"). Our range encompasses goods in the home and garden categories.

(2) A consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity. A business shopper is any natural or legal person, or partnership with legal capacity, acting in the exercise of their trade or independent professional capacity when the contract is formed.

(3) Any deviating, conflicting or supplementary general conditions put forward by the Shopper shall only be incorporated into the agreement where their applicability has been expressly confirmed by us in writing.

2. Contracting Party and Contact

The sale contract is concluded between you and the operator of XEVORA. Full provider details are available on our Legal Notice page.

3. Conclusion of Contract

(1) The display of our home and garden goods in the online shop does not constitute a legally binding offer; it functions solely as a non-binding online catalogue.

(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to acquire the items held in your shopping basket.

(3) Acknowledgement of receipt and acceptance of your order are issued simultaneously — you will receive both immediately after placing your order by means of an automatically generated email. Upon despatch of that confirmation email, the sale contract becomes legally binding.

(4) We retain the contract text and send it to you together with these Terms by email. The Terms in force at any given time are also available at xevora.com/terms-of-service.

(5) Contracts are concluded in the English language.

4. Prices and Shipping Costs

(1) All prices displayed on the website include the applicable statutory Value Added Tax. Any delivery charges are shown separately during the checkout process.

(2) For shipments to territories outside the European Union and the United Kingdom, customs duties, local taxes and further levies may be applied; these fall solely to the Shopper.

(3) Full particulars of delivery charges and estimated shipping windows are available on our Shipping & Payment page.

5. Payment Terms

(1) The following payment methods are accepted: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in particular circumstances.

(2) The full purchase price is due upon conclusion of the contract.

(3) Where payment is made by credit card or PayPal, your account will be debited immediately on completion of the order.

6. Delivery

(1) Goods are sent to the delivery address provided by the Shopper. The applicable delivery windows are indicated on each product page and throughout the checkout process.

(2) Should delivery remain impossible after three attempts, we are entitled to withdraw from the contract. Any amounts already received will be refunded without delay.

(3) Where force majeure occasions a delay, the delivery period will be extended accordingly. We will inform you of any such development as promptly as possible.

7. Retention of Title

All delivered goods remain our property until the full purchase price has been received.

8. Right of Cancellation for Consumers

Consumers benefit from a statutory right of withdrawal. Full cancellation details and the model withdrawal form are available on our Cancellation Policy page.

9. Warranty and Liability for Defects

(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.

(2) For second-hand goods, this period is reduced to one year from the delivery date.

(3) Should any delivered item prove defective, please contact us at contact@xevora.com.

10. Liability

(1) We accept unlimited liability in cases of intent and gross negligence, and within the scope of applicable consumer protection legislation.

(2) In cases of ordinary negligence, our liability is confined to breach of a fundamental contractual obligation — one whose fulfilment is essential to the proper execution of the contract and upon which the Shopper may reasonably rely. In such cases, liability is limited to foreseeable, contract-typical loss.

(3) Liability for injury to life, limb or health is unaffected by the above.

11. Dispute Resolution

(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

12. Applicable Law and Jurisdiction

(1) The contractual relationship is governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection afforded by mandatory provisions of the consumer's country of habitual residence is not thereby removed.

(2) Where the Shopper is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this relationship.

13. Final Provisions

Should any provision of these Terms prove or become wholly or partially void, the validity of the remaining clauses shall remain unaffected. The relevant statutory rule shall stand in place of any invalid provision.
